KyndCreate
Terms, refunds and privacy.
Everything here is written to be read, not to be survived. If something is unclear, ask and it will be explained — and if it turns out the explanation is better than the wording, the wording gets changed.
1. Who you are buying from
KyndCreate is run by Matthew Williamson, a sole trader, of 30 Sidney Road, Forest Gate, London E7 0EF, United Kingdom. Throughout these terms that business is called “Kynd”. You can reach it at support@kyndcreate.com.
Stripe is the seller of record. When you buy a plan or a credit top-up, the sale itself is made by Stripe, which acts as merchant of record. That means Stripe is the party you pay, Stripe appears on your statement, Stripe issues your receipt and handles the VAT or sales tax wherever you are, and Stripe decides any payment dispute.
Kynd provides the service you are paying for, and is who to contact about it. Where these terms describe what you get, that is Kynd’s commitment to you.
2. Plans and credits
Credits are how work is paid for. One credit is one penny. Every job shows what it will cost before anything is made, and you approve it.

Prices include any tax that applies where you are. A yearly plan costs ten months for twelve, and its credits arrive monthly rather than all at once — you have paid for all twelve, and all twelve arrive, one cycle at a time.
Two kinds of credit
- Plan credits arrive with each billing cycle and last for three months. They are spent first, so the credits with a deadline go before the ones without.
- Top-up credits are ones you buy separately. They never expire.
Your account page shows both, and names the date any plan credits are due to expire while there are still some to lose.
What a plan does not do
A plan is credits, not a different product. Every KyndCreate feature is available on every plan and to anyone using credits alone — nothing is held back for a higher tier.
3. Cancelling
You can cancel at any time from your account page, in a couple of clicks. Cancelling stops the plan renewing. It does not take anything away:
- The cycle you are in runs to the end of the period you have paid for.
- Any cycles you have already paid for but not yet received still arrive, month by month. This matters on a yearly plan: cancelling in month two does not forfeit the other ten.
- Credits already in your balance stay yours, subject to the three-month life of plan credits described above.
To move to a different plan, cancel the one you are on and start the new one when it ends. A single account holds one plan at a time.
Your statutory right to change your mind
Because you are buying online, UK consumer law gives you 14 days to cancel a purchase. For digital content and services there is an important exception: once supply has begun with your agreement, that right ends for what has already been supplied.
In practice, and in your favour: if you have made nothing and spent no credits, ask within 14 days and you will be refunded in full. If you have spent some credits, ask anyway — see below.
4. Refunds
Email support@kyndcreate.com and say what happened. The position Kynd takes:
- Something went wrong. If a render fails, or produces nothing usable because of a fault at Kynd’s end, the credits are returned. You should not pay for a failure. Much of this is automatic: a job that does not deliver is reconciled and refunded without you asking.
- You changed your mind and have not used it. Refunded in full.
- You used some of it. Ask. What has genuinely been spent on computing has been spent, but nobody is kept on a plan they do not want.
Refunds are issued by Stripe, as the seller, back to the card you paid with.
5. Your work
What you make is yours. Kynd claims no ownership of your films, images, songs, voices or the characters you create, and does not use your work to train models.
What you put in must be yours to use: your own footage and recordings, or material you have the right to use. Do not upload a real person’s face or voice without their permission. Kynd will remove work and close accounts used to impersonate people or to make material that is illegal.
Your projects and media are stored on your account so they follow you between browsers and into Kynd Agent on a Mac. Keep your own copies of anything you would be upset to lose — this is a creative tool, not a backup service.
6. Your data
Kynd is the data controller for your KyndCreate account. Here is everything it holds and why.

Your card details are never held by Kynd. They go to Stripe, which is the seller and the payments provider.
Who else sees it
Kynd does not sell your data and does not share it for advertising. It is processed by the services needed to run KyndCreate: Cloudflare (hosting, storage and the database), Stripe (payments), the email provider that sends your sign-in link, and the GPU providers that run renders. A render is sent the material it needs to do that job and nothing that identifies you.
How long
Your account and work are kept while your account is open. Records of payments are kept for six years, because tax law requires it. Sign-in attempt records are kept briefly, for security.
Your rights
You do not have to ask for two of these. On your account page in the studio you can download everything Kynd holds about you, and close your account — it shows you exactly what will go before anything does. Closing removes your projects and your media and stops your sign-in working; payment records are kept for the six years above, because they must be.
For anything else — a correction, or a question about what is held — email support@kyndcreate.com and it will be done within 30 days.
If you have a plan running, cancel it before closing your account. Closing while a plan is still billing would take away every way of seeing or stopping the charges, so Kynd refuses to do it in that order.
If you think your data has been mishandled you can complain to the Information Commissioner’s Office at ico.org.uk.
7. Contact, and the boring bits
Use the contact form, or email support@kyndcreate.com. Both reach the same inbox, and a real person reads it.
KyndCreate is a creative tool and is provided as it is. Kynd does not promise that a particular render will produce a particular result — that is the nature of the work. Nothing in these terms limits your legal rights as a consumer, or Kynd’s liability for death, personal injury or fraud. Otherwise Kynd’s liability to you is limited to what you have paid it in the previous twelve months.
These terms are governed by the law of England and Wales.
If these terms change in a way that affects you, you will be told before it takes effect, and the version and date at the top of this page will change.
